1.ACCEPTANCE OF TERMS
EnableSecurity (“VOIPSCANNER.com”) provides its Service(s) (“Service”) to you subject to these Terms of Service ("TOS").  Said TOS may be revised without prior notice, and shall apply immediately to any service in course or to any new service.  Failure to comply with these TOS may result in account revocation.

2.YOUR REGISTRATION OBLIGATIONS
Account registration is required in order to create a VOIPSCANNER.com account. During registration, all users are required to provide accurate, complete and current information about themselves in all required fields. Should any of your own information change after submitting it to VOIPSCANNER.com, you are required to update that information as soon as possible. Should VOIPSCANNER.com suspect that your personal information is not complete, current, or accurate, your account may be subject to suspension or termination.

3.INDEMNITY
You agree to indemnify and hold VOIPSCANNER.com, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any alleged claim or demand. You are solely responsible for your actions when using the Service, including, but not limited to, costs incurred for Internet access.

4.PAYMENT AND BILLING.
As the Account holder, you are responsible for all charges incurred, including applicable taxes, and all purchases made by you or anyone that uses your Account, including your family, friends and co-workers.

5.MODIFICATIONS TO SERVICE
VOIPSCANNER.com reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice at any time. You agree that VOIPSCANNER.com shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

6.TERMINATION
You agree that VOIPSCANNER.com, in its sole discretion, may terminate your account, and remove and discard any content within the Service, for any reason, including and without limitation, the lack of use, or if VOIPSCANNER.com believes that you have violated or acted inconsistently with the letter or spirit of the TOS. You agree that any termination of your access to the Service under any provision of this TOS may be effected without prior notice, and acknowledge and agree that VOIPSCANNER.com may immediately deactivate or delete your VOIPSCANNER.com Service and all related information and files. VOIPSCANNER.com reserves the right to bar any further access to such files or the Service. You agree that VOIPSCANNER.com shall not be liable to you or any third-party for any termination of your access to the Service. Paid accounts that are terminated will not be refunded.

7.DISCLAIMER
The VOIPSCANNER.com SERVICE IS PROVIDED "AS IS" AND YOU USE IT AT YOUR SOLE RISK. VOIPSCANNER.com EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

WITHOUT LIMITATION, VOIPSCANNER.com MAKES NO WARRANTY THAT THE VOIPSCANNER.com SERVICE WILL MEET YOUR REQUIREMENTS, THAT IT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT THE RESULTS OBTAINED FROM THE USE OF THE VOIPSCANNER.com SERVICE WILL BE ACCURATE OR RELIABLE, OR THAT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED THROUGH THE VOIPSCANNER.com SERVICE WILL MEET YOUR EXPECTATIONS.

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE VOIPSCANNER.com SERVICE IS DONE AT YOUR SOLE RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

FURTHER, PLEASE NOTE THAT NO ADVICE OR INFORMATION, OBTAINED BY YOU THROUGH THE VOIPSCANNER.com SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY PROVIDED FOR IN THESE TERMS OF USE.

8.LIMITATION OF LIABILITY
YOU EXPRESSLY UNDERSTAND AND AGREE THAT VOIPSCANNER.com SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF VOIPSCANNER.com HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: 1. THE USE OR THE INABILITY TO USE THE VOIPSCANNER.com SERVICE; 2. THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE VOIPSCANNER.com SERVICE; 3. UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; 4. STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE VOIPSCANNER.com SERVICE; OR 5. ANY OTHER MATTER RELATING TO THE VOIPSCANNER.com SERVICE. IN NO EVENT SHALL VOIPSCANNER.com' TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE), OR OTHERWISE EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THIS SITE.

9.INDEMNIFICATION
YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS VOIPSCANNER.com AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONSULTANTS AND AGENTS FROM ANY AND ALL THIRD PARTY CLAIMS, LIABILITY, DAMAGES AND/OR COSTS (INCLUDING, BUT NOT LIMITED TO, ATTORNEYS FEES) ARISING FROM YOUR USE OF THE VOIPSCANNER.com SERVICE, YOUR VIOLATION OF THE TERMS OF USE OR YOUR INFRINGEMENT, OR INFRINGEMENT BY ANY OTHER USER OF YOUR ACCOUNT, OF ANY INTELLECTUAL PROPERTY OR OTHER RIGHT OF ANY PERSON OR ENTITY. YOU AGREE TO IMMEDIATELY NOTIFY VOIPSCANNER.com OF ANY UNAUTHORIZED USE OF YOUR ACCOUNT OR ANY OTHER BREACH OF SECURITY KNOWN TO YOU.

10. OWNERSHIP and CONFIDENTIALITY
All intellectual proprietary rights now known or hereafter recognized in any jurisdiction in and to the Service and the Reports are owned by VOIPSCANNER.com and its licensors. End-User agrees to make no claim of interest therein or ownership thereto. End-User further acknowledges that the Service's structure, organization, and code are the valuable trade secrets of VOIPSCANNER.com and/or its licensors, and all data and information contained within the Service or the Reports (excluding individual factual data gathered form the End-User’s network IP addresses) are confidential information of VOIPSCANNER.com. End User agrees to keep such information in confidence and not to disclose it to any third parties. End-User may not access, use or refer to any such information except for the limited purpose of generating Reports for IP addresses for which the End-User has requested scans, and using such Reports for internal business purposes, solely for the purpose of vulnerability assessment with regard to the relevant IP address.


11. IP ADDRESSES
Indemnity. (a) End-User represents and warrants that End-User has full right, power, and authority to consent to have the Service scan for vulnerabilities the IP addresses or domain names identified to VOIPSCANNER.com for scanning, whether electronically or by any other means, whether during initial Registration or thereafter. End-User will indemnify and hold harmless VOIPSCANNER.com, its Authorized Resellers, partners and sponsors, and their officers, directors, employees and agents from and against any third-party claims, suits, liabilities, losses, damages, judgments, awards, fines, penalties, costs and expenses (including reasonable attorneys’ fees) incurred by or levied against the same resulting from or based on End-User’s use of or inability to use the Service, including any claim resulting from End-User's breach of this Section 5. (b) End-User also acknowledges and agrees that the scanning of such IP addresses and/or domain names may expose vulnerabilities and in some circumstances could result in the disruption of services at such site(s). Certain optional features of the Service, including exploitive scans, involve substantial risk of Denial of Service (DOS) attacks, loss of service, hardware failure and loss or corruption of data. Consequently, End-User assumes the risk for all damages, losses and expenses resulting from use of the Service.

12. Restrictions. End-User’s use of the Service is subject to the following restrictions and End-User hereby covenants as follows: (a) End-User may use the Service only to scan IP addresses and/or map domain names owned by and registered to End-User, or for which End-User otherwise has the full right, power, and authority to consent to scan. (b) End-User may not use the Service except for the limited purpose of accessing the Service's user interface and reviewing, solely for End-User's own internal business purposes, only such vulnerability test results as set forth in the reports of IP address scans provided by VOIPSCANNER.com (the “Reports”). (c) While there is no software transfer necessary from VOIPSCANNER.com to End-User to effectuate the Service, End-User agrees not to reverse engineer, decompile, or disassemble any software that provides the Service, or otherwise attempt to derive the processes by which the Service is provided or the Reports are generated, except to the extent the foregoing restriction is expressly prohibited by applicable law. 

13.OTHER
These TOS constitute the entire agreement between VOIPSCANNER.com and you, and thus supersede any prior written or oral agreement, communication or proposal between the parties regarding VOIPSCANNER.com. If any part of this TOS shall be determined by any competent authority to be invalid, unlawful or unenforceable, the remainder of TOS shall continue to be valid and enforceable to the fullest extent permitted by law.

14.DISPUTE
These TOS shall be governed by the substantive law of Malta.

Any dispute, controversy or claim arising out of or in connection with this contract, or the breach, termination or invalidity thereof, shall be solved by the Republic of Malta.
